This system is administrated by The HRD Group Ltd (THRDGL) in partnership with Skillgate Ltd on servers based within the UK. Neither THRDGL nor Skillgate accept any responsibility for materials authored or supplied by third party organizations.

Users may access the HRD Healthcare system and use its material only on the basis of accepting ALL the following legally binding statements.

DEFINITIONS

"Users" means all persons entering this system. Users of the system include distributors, fee paying licence holders, fee paying registrants of structured learning programs, and those HR Managers and organizational Directors with a temporary FREE trial licence issued for the purpose of assessing the system and its services prior to purchase of user licences, program registrations, or a customisable system copy.

"Distributors" means King Costa & Associates and their contracted representatives who collectively have exclusive rights to market the system, sell user licences and program registrations and provide client and user support services.

“the system” means the system resident on www.hrd-healthcare.com (or any customisable system copies that may be established).

"Materials" means the system's ebriefings, eprogrammes and software program code, and any supporting code; the system's descriptions and user guides, text, layout and presentation, logos, images, icons, photos, site and eprogramme banners and all other artwork; distributor’s written advice, marketing information, blended learning materials and information on their organisation, partners and representatives, i.e. all materials associated with the www.hrdhealthcare.com website and www.hrd-healthcare.com system, and materials contained on them, within them, or supporting them.

COPYRIGHT

All of the material on the HRD Healthcare website and system is copyrighted. No part of the material may be copied, reproduced, stored in a retrieval system, or transmitted, in any form or by any means, electronically, mechanically, photographed, photocopied, recorded, handwritten, or in any other way retained for use independant of that authorised for personal study.

I.E. users of the system do have permission to print out system material, descriptions, and user guides for their own personal use, or for presentation to their management or tutor, or use within authorised HRD Healthcare training, coaching or mentoring sessions.

NO authority is given to anyone to modify, reproduce, publicize, publicly display or distribute any material, or authorised prints of any material, whether for their use, or any commercial use, or competing purpose, or to any third party. Equally the material must not be used for the development, production of or marketing of a competing learning program, or learning process, or for any other act, commercial or otherwise, which infringes this copyright.

TERMS AND CONDITIONS

  1. All users must be compliant with the copyright statements and accept the system’s owners, administrators, and distributors limited liability statements.
  2. Licences issued or program registrations are for the individual user’s use only and the user must not permit any other person to use their licence, or access their program. The principle of one user – one licence must be strictly adhered to.
  3. Should system trialists decide not to proceed to order at the end of their trial period then their trial licence and all their training records will be removed from the system and they will owe their distributor nothing.
  4. For clients proceeding to order user licences and/or program registrations their distributor will invoice them with the fee and on the payment terms agreed, in writing, where different from these Terms & Conditions.
    NB: Payment of a user system licence fee, or a program registration fee, will entitle the individual user to access the system and their personal training records for 12 months and 24 months respectively.
  5. For system licence fee users on each 12-month anniversary of the users licence subscription date, or any user licence registration arising, the distributor will automatically invoice the licence renewal fees due which will enable the user to use the system for a further 12 months. Should renewal of user licence, or any user licence registration arising, not be required then the user must write to the distributor requesting their removal. This removal instruction must be received within 7 days of the licence subscription's 12-month anniversary.
  6. Manager licence holders may register other users as either a manager, with a user registration facility, or as an employee. All the users to the system that are so registered, and their organisation where different from the manager’s registration details, and all the users that they may register, will also be bound by these copyright, limited liability and terms declarations. Managers will be invoiced for all the user registrations they, and their registrants, make by the distributor at the prevailing licence fee.
  7. All invoices to be paid in full within 14 days of issue date. If invoices are not paid in full within 30 days then the related licences and their attended training records will be removed from the system and will not be reinstated until all monies due have been paid in full – an administration charge of 10% payable in advance will be levied.
  8. Any references or testimonials that are provided may be included on the system, or websites, or in the distributor’s marketing materials, at their discretion. In such instances usage will be to the credit of the originating organisation.

LIMITED LIABILITY

  1. The system’s owners, administrators, or distributors shall not be liable for any consequence arising from failure, or delay, in the performance of any of their obligations, or duties, or support expectations to users of the system.
  2. The system’s owners, administrators, or distributors do not accept any responsibility for materials authored or supplied by third parties.
  3. All the website and system’s material, together with any suggestions, recommendations, opinions, instructions or any other communication made, both oral and written, directly or indirectly, is offered to users in good faith. No condition, warranty or representation, expressed or implied, is given as to its validity or to the results obtained. It is the sole responsibility of the client organisation or individual user for the adoption to their needs, circumstances and operating environment.
  4. The system’s distributors sell user licences to the system and program registrations on the basis that elearning tutor support is not provided, except where tutor supported elearning programmes are advertised as such and made available for existing system users to subscribe to at an additional fee.

PRIVACY STATEMENT

We respect the privacy of system users. The system’s owners, administrators, or distributors will not capture and store any personal information about individuals who access this system, except where it is voluntarily given. The personal data you provide will be used exclusively for providing you, and your authorized management, with the information you have requested, or the learning support you need.

We will not pass any of your personal data to outside organisations and/or individuals unless they are specifically engaged to deliver the learning service you require.

This privacy policy only applies to the HRD Healthcare system, i.e. this privacy statement does not cover links within the system to other websites on the internet.
